*Indian travel agencies reported a 17% drop in international tour bookings after the higher TCS rate took effect in late 2025. From April 1, 2026, the rate dropped to a flat 2% - the lowest it has ever been. If you are still explaining the old rules to clients, or worse, still confused about the rules yourself, this guide covers everything you need to collect, deposit, and explain the tax correctly.*

Tax Collected at Source on overseas tour packages is one of the most misunderstood compliance requirements for Indian travel agents. Most agents know it exists. Far fewer understand exactly when it applies, how to calculate it, what to do with the money, or how to talk about it with a client without losing the booking.

This guide explains the complete picture - from the legal basis to the client script - in plain language.

---

## What Is TCS on Foreign Travel Packages in India?

Tax Collected at Source on international tour packages is a mandatory tax collection requirement under **Section 206C(1G) of the Income Tax Act, 1961**. It applies when a travel agent or tour operator sells an overseas tour package to an Indian resident.

The seller - meaning your agency - collects a percentage of the package cost from the client at the time of payment. That collected amount is then deposited with the Income Tax Department on the client's behalf. The client can later claim it as a credit against their total tax liability when they file their annual ITR.

TCS is not an additional cost to the client in the long run. It is an advance tax payment - a deposit against what the client already owes the government. But in the short term, it increases the upfront cash outflow, which is why it affects booking decisions.

## How TCS on International Tour Packages Changed in 2026

The TCS rules for overseas travel have changed significantly over the past two years. Understanding the history helps you explain the current rules accurately.

| Period | Rate | Threshold | With PAN | Without PAN |
|---|---|---|---|---|
| Before October 2023 | 5% | No threshold | 5% | 10% |
| October 2023 to March 2026 | 20% above Rs 7 lakh | Rs 7 lakh per year | 20% | 40% |
| April 1, 2026 onwards | Flat 2% | No threshold | 2% | 4% |

The current rate - effective April 1, 2026 - is **flat 2% with no minimum threshold**. This means TCS applies from the first rupee of any overseas tour package, but at a much lower rate than before.

**What counts as an overseas tour package for TCS purposes?**

Any tour package that includes at least two of the following: travel, accommodation, food, local transport, or sightseeing outside India. A standalone international flight ticket does NOT attract TCS under this section. Selling only a visa or only a hotel booking also does not trigger it. The package must be sold as a bundled product.

## How to Calculate TCS on a Foreign Tour Package - With Examples

TCS is calculated on the **total package value including GST**.

**Example 1 - Family Europe package**

A family of four books a 10-day Europe package for Rs 8,00,000 (including GST). TCS at 2% = Rs 16,000. Total amount collected from client = Rs 8,16,000.

**Example 2 - Couple Maldives package**

A couple books a Maldives package for Rs 1,20,000. TCS at 2% = Rs 2,400. Total collected = Rs 1,22,400.

**Example 3 - Client without PAN**

If the client does not provide a valid PAN or Aadhaar-linked PAN, the rate doubles to 4%. TCS on Rs 1,20,000 = Rs 4,800. Always collect PAN before confirming a booking - it is good practice and saves the client money.

---

## Step-by-Step: How to Collect and Deposit TCS as a Travel Agent

### Step 1 - Collect PAN from the client

Before issuing any international tour package invoice, collect the client's PAN. If PAN is unavailable, the rate is 4% instead of 2%. Document this in your booking records.

### Step 2 - Add TCS to the invoice

Show TCS as a separate line item on the invoice. Label it clearly: 'TCS under Section 206C(1G) at 2%'. Do not embed it in the package price. Transparency here prevents disputes later.

### Step 3 - Collect the TCS amount from the client

Collect the full package amount including TCS at the time of payment. The TCS belongs to the Income Tax Department - it should not be used as operating cash.

### Step 4 - Deposit TCS by the 7th of the following month

TCS collected in any calendar month must be deposited with the government by the 7th of the next month. Use Challan 281 (TCS/TDS challan) via the [Income Tax India](https://www.incometax.gov.in) e-filing portal or authorised bank branch. Use your TAN - not your PAN - for TCS deposits.

**One exception - March:** TCS collected in March must be deposited by April 30 (not April 7). This is the only month with a different deadline, because it falls at the end of the financial year.

**Do you need a TAN?** Yes. If you are collecting TCS, your agency must have a Tax Deduction and Collection Account Number (TAN). Apply online at the [Income Tax India](https://www.incometax.gov.in) portal using Form 49B. TAN registration typically takes 7 to 10 working days.

### Step 5 - File quarterly TCS returns (Form 27EQ)

TCS returns must be filed quarterly:

| Quarter | Period | Due Date |
|---|---|---|
| Q1 | April to June | July 15 |
| Q2 | July to September | October 15 |
| Q3 | October to December | January 15 |
| Q4 | January to March | May 15 |

File Form 27EQ through the [Income Tax India](https://www.incometax.gov.in) e-filing portal or via your CA.

### Step 6 - Issue Form 27D to the client

After filing quarterly returns, issue **Form 27D** (TCS certificate) to each client within 15 days of the return due date. This is the document the client uses to claim the TCS credit when filing their ITR. Most clients will ask for this - have a system to issue it promptly.

---

## What Happens If You Miss TCS Compliance

Non-compliance carries real penalties. The Income Tax Department has been actively auditing travel agencies since 2024.

| Violation | Penalty |
|---|---|
| Failure to collect TCS | Interest at 1% per month on the uncollected amount |
| Failure to deposit TCS on time | Interest at 1.5% per month plus penalty equal to uncollected TCS |
| Late filing of Form 27EQ | Rs 200 per day of delay up to the TCS amount |
| Failure to issue Form 27D | Penalty under Section 272A - up to Rs 100 per day |
| Operating without TAN | Penalty under Section 272BB - up to Rs 10,000 |

The most common mistake is collecting TCS from the client but depositing it late. Set a calendar reminder for the 7th of every month.

## How to Explain TCS to Your Client Without Losing the Booking

This is where most travel agents lose bookings - not because TCS is actually a problem, but because it is explained poorly.

**The wrong way:** 'There is an extra 2% government tax on your booking.'

**The right way:** 'There is a 2% TCS on your package - that is Rs 2,400 on this booking. This is not an extra cost. It is an advance against your income tax. When you file your ITR, you get this back as a credit. We will give you a Form 27D certificate that your CA can use when filing your return.'

**If the client asks why it exists:** 'The government introduced it to track high-value foreign spending. It is standard across all travel agents in India - not something specific to us.'

**If the client pushes back on the timing:** 'I understand it feels like extra money right now, but it is money you would have paid in tax anyway. You are just paying a small part of it earlier.'

No. TCS under Section 206C(1G) applies only to overseas tour packages - not to standalone international flight tickets, hotel-only bookings, or visa-only services. Yes. TCS paid on an overseas tour package is not a final tax - it is an advance payment against the client's total income tax liability for the year. When the client files their annual ITR, the TCS amount is credited against the tax they owe. If their total tax liability is lower than the TCS paid, the difference is refunded by the Income Tax Department. Clients with income below Rs 7 lakh per year under the new tax regime can claim the full TCS back as a refund.

## Bottom Line

Tax Collected at Source on international tour packages became significantly more manageable from April 1, 2026 - flat 2% with no threshold, down from 20% above Rs 7 lakh. The agents who handle this well are not the ones who avoid the conversation with clients. They are the ones who explain it clearly, invoice it properly, deposit it on time, and hand over Form 27D without being asked. Compliance is not a burden - it is a trust signal.
